Under the Biden administration, the Chemical Safety Board (CSB) is likely to ramp up investigations into accidental releases of hazardous chemicals into the air – and companies would be wise to take note, advises Bloomberg Law. More than a decade ago, the Government Accountability Office (GAO) slammed the CSB for “investigation gaps” – gaps the agency is now reportedly looking to close.
What can companies expect? The CSB intends to release guidance interpreting its incident reporting rule, mandated by the Clean Air Act and finally adopted in 2020, in response to comments that the rule is vague and not always easily applied. According to the article, the CSB is also expected to expand and formalize desk investigations, meaning “the scope and conduct of a company’s post-incident internal investigations, therefore, will become even more important given the potential for external scrutiny.”
